Eco-Roots Travel - Terms of Use

1. Relationship with Waybird

Eco-Roots Travel acts as an affiliate of Waybird Inc. ("Waybird"). Waybird is the platform we use to build itineraries, manage bookings, and process payments. All bookings and travel services are ultimately provided by Waybird and its trusted suppliers.

2. Contract with Client

For all bookings made through Eco-Roots Travel, the actual contract for the travel services is between you (the client) and Waybird. Eco-Roots Travel is not a party to that contract. We act as an intermediary to help you plan and book your trip through Waybird's platform.

3. Payments

All payments for bookings are processed by Waybird. Eco-Roots Travel does not handle payments directly and is not responsible for payment processing, security, or refunds. Please refer to Waybird's terms for payment-related issues.

4. Limitation of Liability

Eco-Roots Travel is not liable for any loss, injury, damage, or delay resulting from:

• The services provided by Waybird, Travel Providers, or other suppliers.

• Circumstances beyond Waybird's or our control (e.g., natural disasters, political unrest).

• Your failure to comply with Waybird's terms and conditions.

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to your use of our website or services is limited to $200.

5. Travel Protection

We strongly recommend that you purchase a comprehensive Travel Protection Plan, including "Cancel for Any Reason" coverage. Such a plan should, at a minimum, cover trip cancellation or interruption, medical expenses, emergency evacuation/repatriation, and baggage loss.

If you choose to travel without adequate travel protection, Eco-Roots Travel will not be liable for any losses that a travel protection plan would otherwise have covered.

6. Information Accuracy

While we strive to provide accurate information, Eco-Roots Travel is not responsible for any errors, omissions, or inaccuracies in the information, pricing, or availability of travel services displayed on Waybird's platform. Always verify details directly with Waybird or the Travel Provider.

7. Assumption of Risk

You understand that travel involves inherent risks, including but not limited to physical injury, illness, emotional distress, property damage, and delays. By booking travel services through Eco-Roots Travel, you voluntarily assume all such risks.

8. Release

You hereby release Eco-Roots Travel from any and all claims, liabilities, damages, losses, costs, and expenses (including attorneys' fees) arising out of or in any way connected with your travel arrangements or your use of our website or services.

9. Arbitration and Class Action Waiver

Any dispute arising under or relating to these Terms of Use shall be resolved by binding arbitration in accordance with the rules of [Insert Relevant Arbitration Organization, e.g., the American Arbitration Association]. You waive your right to participate in a class action lawsuit.
